The General Conditions of Selling for the purchase of Lisa Tibaldi Terra Mia products (“Products”) on this site (“Site”) by Lisa Tibaldi Grassi, Via Garibaldi,23 -04020 - Santi Cosma e Damiano (LT), Partita IVA 03006070597 ("Lisa Tibaldi Terra Mia"or, alternatively, the“Vender”), are included in this sales contract (“Contract”). Every user who sails on the Site (“User”) is invited to take a look at the Contract before completing a purchase order of Products on the Site (“Order”); sending an Order implies acceptance of the Order. Each change to the Contract will become effective immediately with publication on the Site and will regulate all subsequent Orders.
1. Customers
The conclusion of Orders on the Site is permitted only to natural persons who have the legal capacity to enter into binding agreements in accordance with applicable law and act for purposes other than business or professional activity where appropriate ("Clients").
Where requested, the Customers must provide name, surname, date of birth, email address, Product delivery address, tax code and other personal information. This information must be true, accurate and constantly updated.
The User may not carry out Orders on the Site using the nominative or credentials of another entity, unless it has been expressly authorised by the rightful person.
Purchase of Products for resale purposes is prohibited.
General Conditions of Selling do not regulate the provision of services or the sale of products by subjects other than the Seller who are present on www.lisatibalditerramia.com via links, banners or other hyperlinks. We recommend that you, before forwarding orders and buying products and services from different agents from the Seller, verify their terms of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or the conclusion of electronic commerce operations between users of www.lisatibalditerramia.com and third parties.
2. Acceptance of an Order – Sales contract
Before purchasing the products, through the transmission of the order form, you will be asked to read the General Conditions of Sales and the Information on the Right of Recession, to print a copy of it and to store or reproduce a copy of it for your personal uses. We will also provide you with a summary of the commercial and contractual conditions we propose for the purchase of the products, in which a reference is contained to the General Conditions of Selling and a summary of the information on the essential characteristics of each ordered product with its price (including all applicable taxes or taxes), the means of payment you can use to purchase each product, the way the products purchased, the methods of processing complaints by the professional, shipping and delivery costs; and the references and geographical and email address of the Seller and the date by which the Seller undertakes to deliver the goods.After the electronic forwarding of an Order, the Customer will receive an email confirming the receipt of the Order.
This communication is functional to inform the Customer that the Order has been received and to provide it with the Order’s unique identification code. It does not in any way imply the acceptance of the Order by the Seller. If one or more of the data reported in the email are not correct, the Customer will have to communicate it to the customer service of the Seller ("Servizio clienti") by email to: info@lisatibalditerramia.com or through the link included in the confirmation of receipt of the Order.
The Order will be accepted by the Seller only when the Order sends the Customer the confirmation of acceptance of the Order ("Confirmation of Order"). The contract must be considered to be perfected at the time of the receipt of the Confirmation of Order by the Customer.
Before that, the Seller reserves the right not to accept an Order where it considers it appropriate. In particular, the Seller will not be responsible, under any circumstances, in the event that a ordered product is removed from the Site after sending its Order. It may be that the Site may expose products not available at the moment by mistake.
In the case of partial unavailability of the Order, the Customer Service will contact the Customer to verify the Customer’s will to (a) receive a partial Order, (b) the Comprehensive Order in multiple expeditions or (c) to cancel the Order.
In the case of the Order’s total unavailability, the Customer Service will contact the Customer to inform him that the Order cannot be tried and cancel its Order. In such a case, no charges will be made against the Customer.
3. Payments
Orders can be made using the main credit cards, debit cards or other payment methods made available on the Site (collectively,"Payment methods").
The Seller will charge the purchase price as follows ("Price") in conjunction with the acceptance of the Order. However, at a stage prior to the acceptance of the Order, safety checks may be carried out on the Payment Method chosen by the Customer for the Order, or a pre-authorisation or pre-debit for precautionary purposes.
The Seller has a primary payment gateway to authorise payments of Orders ("Payment Gateway"); therefore, the Seller does not directly manage any financial information relating to the Payment Method used by the Customer, nor does the Site process any financial information provided for the completion of the Order.
The Payment Gateway protects the details of the credit card or debt used by encrypting sensitive information to ensure that they are safely transmitted. TFurthermore, information will never be used by the Seller except to complete the procedures for your purchase and to issue the related refunds in case of any refunds on the products, following the exercise of your right to withdraw, or if you make it necessary to prevent or report to the police force the fraud commission on store.dolcegabbana.com.
In the remote event of error, negligence or wrongdoing relating to the management of the transaction connected to an Order by the Payment Gateway and brokerage systems in payments, neither the Seller nor the Site may be held liable for such error, negligence or wrongdoing.
The Seller reserves the right to cancel a transaction and cancel its Order in case fraudulent use of the Payment Method adopted for the Order is reported. Furthermore, the Seller will not be responsible for any unlawful use of a Payment Method by third parties which is not due to its error or negligence.
4. Consignments and deliveries
Lisa Tibaldi Terra Mia ship and deliver the Orders using primary couriers.
The Seller undertakes to deliver the Orders to the Customers in a precise and rapid manner, in accordance with the delivery deadlines indicated in the Site at the purchase stage and, in any case, within 60 (sixty) days of the date of sending the Confirmation of Order to the Customer.
The Confirmation of Expedition is sent to the Customer at the time the Products are delivered to the courier for dispatch.
In certain circumstances, such as periods of balance or business closure, delivery times may change. The Seller cannot be held liable for delays in delivery not due to his fault or negligence. Therefore, the Seller will be free of responsibility for delays due to force majeure, strikes, natural disasters, facts relating to customs clearance procedures, and any other facts relating to the provision of courier services or any other circumstance outside its control. In the Confirmation of Expedition is indicated the tracking number (tracking number) with which the Customer can monitor the process of shipment and delivery of the Products on the website of the relative carrier. The Customer is invited to do everything in his power to facilitate the Order’s address, making himself available for reception or by delegate it to third parties. The courier will make a first attempt to deliver the Order to the address indicated by the Customer. If the delivery is negative, the carrier will inform the Customer of the attempt to deliver and try to agree with the Customer on a further delivery of the Order.
In the event that the courier fails to deliver the Order permanently, the Customer Service will contact the Customer to verify his interest in a new shipment. At the time of delivery, the Customer will have to verify the accuracy of the number of packages and the integrity of the outer packaging. In the event that the Customer finds anomalies in delivery, for example with regard to the number of packages or in the presence of damage to the external packaging, the Customer will have to subscribe the delivery document and contact the Customer Service with reservation. If the Customer fails to do so, he shall not be able to object to any disputes concerning the delivery, subject to the provisions of the subsequent art. 8 in the field of occult vices and in compliance with the law which is placed to the unremitting protection of consumers.

Selecting a different country of delivery, prices, general conditions and availability of items could undergo variations.

6. Guarantees and Product Price Indications
On www.lisatibalditerramia.com are offered for sale only products contradicted by the Lisa Tibaldi brand and purchased directly from the Seller at the fashion house.
The Seller does not sell used, irregular or quality products below the corresponding standards offered on the market.
The essential characteristics of the products are presented on www.lisatibalditerramia.com within each product sheet. The images and colours of the products offered for sale on www.lisatibalditerramia.com may not, however, correspond to the real ones by the effect of the internet browser and the monitor used. TThe products are equipped with a single-use seal identification card. We ask you not to remove the card and its seal from the products purchased, of which are an integral part.The Seller, in the event of the exercise of your right to withdraw, may not accept the refund or not repay the sums paid for the purchase in full, in relation to those products that are without the relevant card or have been altered in their essential and qualitative characteristics or have been damaged.
All prices published on the website www.lisatibalditerramia.com are included in VAT (Prices). As regards the costs of dispatching Orders ("Expedition information"), the Customer will have to refer to the information section on shipments.
The amount of the shipping costs (where due), including VAT, will be visible in the summary of the Order during the checkout procedure and will be reported in the Order Confirmation sent to the Customer following the Order’s acceptance.
Any changes to the Prices of Products will be effective from the date of publication of the new Prices on the Site, without retroactive effect on the Orders already accepted by sending Confirmation of Order. Without prejudice to the case of an error which is recognizable under Article 10. 1431 c.c., the Seller reserves the right not to accept an Order because of the price incorrect published on the Site or indicated in the email sent to confirm the receipt of the Order, that is, before the Seller’s acceptance of the Order.
7. Voucher and discount codes.
During marketing campaigns, the Seller can make available to the voucher Customers and discount codes for the purchase of Products on the Site. The vouchers and discount codes issued by the Seller are not refundable in any case.
8. Non-compliant products – Legal guarantee
Without prejudice to the provisions of the previous art. 4. The Seller assumes responsibility for any defect originating in the Products.
The Seller shall ensure to the Customer that the products sold are not defective and that they comply with the provisions of the Agreement, in particular that the Products:
- • respect the description given on the Site and possess the qualities of the Products that Lisa Tibaldi Terra Mia presented to the Customer as a sample or model;
- • are appropriate for the purpose for which goods of the same type are normally used;
- • they have the quality and the usual performance of the same type of goods, which the Customer can reasonably expect, given the nature of the good.
For technological reasons, neither Lisa Tibaldi Terra Mia nor the Site can ensure that the display of colors on the screen will always be accurate.Marginal differences between the description of the Product on the Site and the actual characteristics of the Product will not be considered as a cause of non-compliance of the Product for the purposes of this Agreement.The guarantee of compliance of the Products sold on the Site lasts for a period of 2 (two) years from the date of receipt of the Products by the Customer.The rules laid down in Articles 129, 130 and 132 of the Consumer Code shall apply to the sale of the Products. If a non-compliant product is delivered, the Customer may request the reinstatement, without expense, of the conformity of the Products by repair or replacement. Where this is not possible, the Customer will be entitled to a corresponding reduction in the Purchase Price or the refund of the Purchase Price and (where incurred) of the Expenditure of Consignment.
The Customer will notify Lisa Tibaldi Terra Mia of any deficiency in the conformity of the Products within a period of 2 (two) months of the date on which she discovered the deficiency of complianceforwarding an email to info@lisatibalditerramia.com.After receiving notification from the Customer, the Seller will contact the Customer to agree directly with the same method of withdrawing the Products.
The mere receipt of the Products by the Seller after the activation of this procedure does not in any way imply the recognition of a lack of conformity of the Products, being necessary an accurate verification by the Seller.The action to assert occult defects shall, in any event, be prescribed within twenty-six months of the delivery of the Product.
9. Replacement and return of Products – Right to withdraw
Within 30 (thirty) days of the Order’s delivery, the Customer is entitled to:
- • request the replacement of a Product with a unit of the same Product of different colours or sizes; or
- • exert withdrawal from the Contract, without any penalty and without having to provide any reason "Recesso".
To this end, in order to verify compliance with the above deadline, the date of delivery of the products resulting from the delivery tracking system made available by the carrier on its website will be authentic. If it decides to apply for the replacement of the Products or to exercise the above-mentioned Recessory, the Customer must notify Lisa Tibaldi Terra Mia in any of the following notification modes:
- Activating the appropriate procedure after tracking its Order in the section "Orders and Renders" in the main menu of the Site;
- Contacting the Customer Service by sending an email to: info@lisatibalditerramia.com

If the Customer chooses to contact the Customer Service for the Residues, the same will have to gently specify the unique identification code of the Order included in the Confirmation of Order. The possibility of return is only active on the Orders that are already delivered to the Customer according to the tracking system provided by the carrier. The return or replacement form will be pre-compiled by the Seller; the Customer will have to verify the correctness of the data given therein and, however, ensure that the notification gives the Order’s unique identification code and any request to replace the Product with a unit of the same Product of different colour and/or size.
Within the return or replacement form, the Customer may indicate the reasons for the return and any notes (e.g. any defects found). After receiving the notification, Lisa Tibaldi Terra Mia will e-mail the Customer to confirm receipt of the request for Recesso or replacement, containing the nullity for the return shipment of the Products ("Nullaosta"). The Nullaosta could however be denied in case Lisa Tibaldi earth Mia verifies the shortage of the assumptions for the Recesso or replacement, for example because more than 30 (thirty) days have passed since the date of delivery of the Products to the Customer.
For the return shipment, the Customer can contact only the carrier indicated by Lisa Tibaldi Terra Mia in the return form and/or in the Nullaosta to book the withdrawal of the Products and will have to place on the relative neck for the shipment the label provided to him by Lisa Tibaldi Terra Mia via email.
The Customer will have to deliver the Products to the courier for the return shipment to Lisa Tibaldi Terra Mia within 14 (fourteen) days of the date of receipt of the Nullaosta.
In particular:
- • the products rendered must be returned with each label, safety seal, packaging and accessories (custody, coat hanger, dress covers, etc.) received with the Order;
- • Products, labels, safety seals, packaging and accessories should not show any sign of use, or scratch, or have been altered in any way (weared, washed, stretched, etc.) and will have to be returned in the same condition as they were shipped by the Seller and their original inner packaging “Lisa Tibaldi Terra Mia”.
Not the purchase price and the shipping costs relating to:
- • Products from which the safety seal has been removed or cut; and/or
- • Products which are used, incomplete (in particular in the case of missing parts or accessories), ruined, damaged, deteriorated or dirty.
- • Products made without the inner packaging “Lisa Tibaldi Terra Mia”.
- The Customer will be considered the sole responsibility for any decrease in the value of the Products resulting from manipulation other than that necessary to establish the nature, characteristics and functioning of the Products.
Once the requirements for the replacement of the Product or for the period of the Recession have been verified, the Seller shall notify the Customer of the acceptance of the return and shall replace the Product or, in the case of Recession, the refund of the Purchase Price and any shipping costs incurred by the Customer ("Refund").
Provided that the Customer has correctly followed this procedure, the costs of shipping the surrenders will be fully borne by the Seller. The Seller undertakes to carry out the Reimbursement procedure described above within 14 (fourteen) days from the date of receipt of the Reimbursement products. Refund will be made through the same payment method as the Customer for the Order.
In the event that the Customer has made the Products in the absence of the Recessing conditions, Lisa Tibaldi Terra Mia will not be able to recognize any right of withdrawal. In this context, the Seller will return the Product to the Customer, after verification of its availability to that effect, reserved to charge subsequent shipping expenses to the Customer. After multiple recesses and returns by a Customer, the Seller may reserve the right to decide whether or not to accept an Order part of the same Customer. Customers will have to ship the Products for the return from the same country where the Products were delivered.
10. Applicable law and disputes.
These General Conditions of Selling and the Sales Contracts of the same Regulations are governed by Italian law, and in particular by Legislative Decree No 206 of 6 September 2005 on the Consumer Code to Chapter I of the “Consumer Rights in Contracts”, with specific reference to the rules on distance contracts and Legislative Decree No 70 of 9 April 2003 on certain aspects relating to electronic commerce.
All disputes relating to these General Conditions of Selling and contracts under the same Regulations shall be known by the competent Court of the place of domicile or residence of the Customer under the applicable law or, at the same time, by the Court of Cassino (FR). The possibility of promoting the extrajudicial settlement of disputes, as provided for in Articles, is saved. 66 and 141 Consumer Code.
11. AMENDMENT AND AGGIORNAMENT
The General Conditions of Selling are amended from time to time also in view of any regulatory changes. The new General Conditions of Sales will be effective from the date of publication on www.lisatibalditerramia.com.
